The undersigned Beneficiary(ies) hereby hire CJ Investment
Services, Inc. to perform foreclosure services in connection with that
certain promissory note secured by deed of trust as described on the attached
Loan Information Statement. Furthermore, the undersigned hereby declare(s)
under penalty of perjury that the statements made on the attached loan
information statement are true and correct to the best of their knowledge
Foreclosure procedure is regulated by Section 2924 of
the Civil Code. The fees that may be charged to a borrower for specific
acts required by the Civil Code are also regulated. Any deposit we
may ask you as the lender to make toward those fees may earn interest at
the legal rate from the date deposited until repaid. Any advances
that you make under the terms and conditions of said Deed of Trust should
be reflected by a statement of payment, receipt or copy of check for taxes,
insurance, attorney's fees, or any payment made on the prior loan(s), etc.
If called for in your note, interest at the legal or note rate may also
be charged to the borrower on your advances.
From time to time, as a lender, you may need assistance
and/or additional services that are not normally part of a foreclosure,
such as document preparation, portfolio review, investment analysis, property
analysis, assignments, clerical support, etc. These services may
be provided to you by CJ Investment Services, Inc. The fees you will
pay for these additional services may not be passed on to the borrower
through your foreclosure action.
The undersigned hereby agree(s) to pay all costs and trustee's
fees to CJ Investment Services, Inc. upon their demand. It is further
agreed that, in the event you acquire said property, CJ Investment Services,
Inc. may hold for recording any and all necessary documents until all costs
and/or expenses are paid in full.
The undersigned further agrees not to accept payments
from the borrower and to close or cancel all collection accounts during
the course of the foreclosure. Please keep in mind that while we
are experienced in foreclosures and loan collections, we are not attorneys
and therefore cannot provide you with legal advise or counsel. If
the occasion should ever arise that you need to consult with an attorney
and you do not have one, we can make several recommendations of attorneys
with whom we have dealt with.
By signing a copy of this disclosure, you are acknowledging
your complete understanding of the facts contained herein and you are agreeing
that you will be responsible for any fees charged to your account that
may not be passed on to the borrower through your foreclosure action.
Furthermore, you are acknowledging that CJ Investment Services, Inc., it's
officers and/or employees are not acting as attorneys in the capacity of
providing legal advice or counsel. You are also acknowledging receipt
of a copy of the foregoing.
The undersigned further agrees to indemnify and hold CJ
Investment Services, Inc. harmless from and against any and all claims,
demands, causes of action, suits, damages, loss, liability, costs and expenses,
including attorney's fees, incurred by CJ Investment Services, Inc. in
connection with or arising out of this foreclosure. In the event
that litigation is commenced to enforce the terms of this agreement, the
prevailing party shall be reimbursed for attorney's fees.
PLEASE NOTE: If you have any knowledge or receive information
during the foreclosure proceedings that the current owner(s) of the property
have filed BANKRUPTCY or are engaged in any form of the Military Service
which would entitle them to the benefits of the Soldiers' and Sailors'
Civil Relief Act of 1940, notification must be given to CJ Investment Services,
